Everyone knows someone who has been injured in a car accident. Given the massive number of auto injury claims presented every year, it should come as no surprise that the insurance industry has a massive workforce that is dedicated to minimizing the value of these claims. The insurance company, along with their adjusters and lawyers, acts immediately to collect evidence to help their case.
Answers To 10 Common Questions About Auto AccidentsIt is our goal to level the playing field. The insurance company would rather take on you than a law firm. Why? Think about it. WHAT SHOULD I DO AFTER AN ACCIDENT?
First, seek medical attention for your injuries. Second, contact one of our attorneys to discuss your case. All claims are governed by a Statute of Limitation. (The time that you have to recover for your injuries) If your case is not settled or filed with the Court by the statute date, you will lose your right to recover for your injuries. Remember, the insurance company has probably already appointed an investigator and an adjuster to build a case for the insurance company. Do not delay as valuable evidence can be lost, forgotten, etc. Try to write down all facts surrounding the accident. Include witnesses, locations, road conditions, insurance information and medical information. Present this information to one of our attorneys. It will give us a good place to start when evaluating your case.
SHOULD I SPEAK WITH THE INSURANCE COMPANY?
ABSOLUTELY NOT! The insurance company may want to take a recorded statement in an effort to build their case. Do not speak with anyone at the insurance company until you have first spoken with one of our lawyers. We routinely participate in recorded statements via three way conference calling to make sure that the insurance company is playing by the rules.
WHAT ABOUT HEALTH INSURANCE? MEDICAL PAYMENT COVERAGE?
You may be able to look to multiple sources to pay your medical bills. Medical payment coverage may be available under the insurance policy for the car that you were riding in when injured. If you were injured in someone else's car, your own auto policy could provide additional medical payment coverage. There are other instances where additional medical payment coverage could be available. We can discuss medical payment coverage during your free consultation.
In addition to medical payment coverage, you may also be able to use your health insurance, Medicaid, Medicare or other policies to help pay your bills. Some of these sources require that you pay them back at the end of your case. Some do not. In many instances, we can negotiate a reduced repayment for you. Once again, we can discuss all insurance issues during your free consultation.
WHAT TO DO NEXT
You should discuss your case with a lawyer. Let us explain the law and answer any questions that you may have. We will meet with you in person or we can talk over the phone. Depending on your location, we may be able to meet at your home or other location convenient to you. You only get one chance to settle with the insurance company. Make sure that you have our firm working for you.
